1. Who you are agreeing with

This website at 38-wins.com (the Site) is operated by Honey Badger Games Ltd (we, us), a private limited company registered in Cyprus under registration number HE 409308, with its registered office at Agias Zonis 12, Agia Zonis Center, Floor 4, Flat/Office 404, Agia Zoni, 3027 Limassol, Cyprus. You can reach us at [email protected].

By using the Site you accept these Terms. If you do not accept them, please do not use the Site.

2. What the Site is

The Site is a game: you spin for a historical squad, draft players into a formation, and a simulation plays out a season based on your selections. It is provided free of charge, for entertainment.

There is no account, no sign-in, and no payment on the Site. Your progress is stored in your own browser, as described in our Privacy Policy.

3. Your progress is not backed up

Because everything is stored locally in your browser, your squads and scores can be lost — by clearing your browsing data, using private browsing, switching browser or device, or by your browser evicting storage on its own. We hold no copy and cannot restore anything. Please do not treat the Site as a durable record of anything you care about.

4. How you may use the Site

You may play the game and share links to it. You may not:

• copy, scrape, extract, or redistribute the Site's data sets, ratings, or code, or build a competing product from them;
• reverse-engineer or tamper with the game in order to falsify results, or present manipulated results as genuine;
• attack, overload, or attempt to gain unauthorised access to the Site or its infrastructure;
• use the Site unlawfully, or in a way that damages us or another user.

5. Intellectual property

The Site, its design, code, artwork, text, the 38 Wins name and logo, and the compilation and presentation of the data within it are owned by Honey Badger Games Ltd or licensed to us, and are protected by copyright and other rights. These Terms give you permission to play the game; they do not transfer any ownership to you.

This applies to our own material only. Club, competition, and player names, and any other third-party names or marks appearing in the game, are not ours and we claim no rights in them — see section 6.

6. Real players, clubs, and competitions

The game refers to real footballers, clubs, national teams, and competitions in order to identify them. That is all it is: identification.

• No club crests, emblems, logos, kit designs, or other club imagery appear anywhere on the Site. Clubs, national teams, and competitions are referred to by name, as plain text, and nothing more. There are no player photographs either.
• We are not affiliated with, endorsed by, or sponsored by any club, league, national association, competition organiser, player, or governing body. Nothing on the Site should be read as suggesting any such connection.
• Club and competition names, and player names, are used descriptively — to say which real team or player a game element represents. All associated trade marks remain the property of their respective owners.
• Player information is compiled from publicly available sources. Ratings and grades are our own editorial estimates, produced for gameplay. They are opinion, not measurement, and they are not a statement of any player's actual ability, market value, or professional standing.
• Simulated results are generated by a model for entertainment. They are fiction, and they predict nothing about real matches.

If you hold rights in material used here and believe it is used improperly, write to [email protected] and we will deal with it promptly.

7. No gambling

The Site involves no wagering, no prizes of monetary value, and no real-money element of any kind. It is not a gambling product and must not be used as the basis for betting decisions.

8. Availability

We make no promise that the Site will be available without interruption or free of errors. We may change, suspend, or discontinue any part of it, or the whole of it, at any time and without notice. Being free, it comes with no service commitment.

9. Links to other sites

The Site links to the App Store, Google Play, and honeybadger.games. We are not responsible for those destinations or their content, and their own terms and privacy policies apply once you arrive.

10. Disclaimer of warranties

To the fullest extent permitted by law, the Site is provided “as is” and “as available”, without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

11. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive loss, nor for lost data, lost progress, lost profits, or lost goodwill, arising out of your use of the Site.

In any event, our total aggregate liability arising out of or in connection with the Site shall not exceed EUR 100.

Nothing in these Terms limits liability that cannot lawfully be limited — including liability for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep all mandatory rights under the law of your country of residence, and nothing here overrides them.

12. The mobile apps are separate

These Terms cover the website only. The 38 Wins apps for iOS and Android are distributed through the App Store and Google Play under their own terms, and are covered by the Honey Badger Games terms.

13. Changes to these Terms

We may update these Terms. The date at the top of this page shows when they last changed, and the current version always governs your use of the Site. If a change is significant, we will make that clear on the Site rather than relying on you to notice.

14. Governing law

These Terms are governed by the laws of Cyprus, and the courts of Cyprus have jurisdiction. If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer-protection rules in your own country, or of your right to bring proceedings there.

16. Severability

If any provision of these Terms is held unenforceable, the remaining provisions continue in full force.
